Hereinafter referred to as "the Seller".
ARTICLE 2 – PURPOSE AND SCOPE
These General Terms and Conditions of Sale ("Terms") govern all sales concluded between the Seller and any consumer (hereinafter "the Customer") making a purchase on the website remind-collection.com.
By placing an order on the website, the Customer acknowledges having read, understood, and accepted these Terms without reservation, in accordance with applicable French consumer law.
The Customer declares that they have the legal capacity to enter into a contract, i.e. that they are of legal age and are not under guardianship or legal protection measures.
ARTICLE 3 – PRODUCTS
The Seller offers for sale home linen and ready-to-wear items.
The Seller endeavours to present products as accurately as possible, particularly with regard to colours and photographs. However, due to variations in screen display settings, the Seller cannot guarantee an exact reproduction of the actual colours of the products.
Product offers and prices are valid subject to available stock. The Seller reserves the right to modify its catalogue and pricing at any time, without prior notice and without this giving rise to any right to compensation for the Customer.
ARTICLE 4 – PRICES
All prices are displayed in euros (€) inclusive of all applicable taxes (VAT included), excluding delivery costs. Applicable delivery costs are indicated during the checkout process, before final confirmation of the order.
The Seller reserves the right to modify prices at any time. Products will be invoiced on the basis of the price in effect at the time the order is confirmed.
ARTICLE 5 – ORDERS
To place an order, the Customer follows the steps below:
1. Selection of products and addition to cart
2. Review of cart contents
3. Entry of delivery and billing information
4. Selection of payment method and payment validation
5. Order confirmation by email
The sales contract is concluded at the date of payment validation. A confirmation email summarising the order is sent to the Customer.
The Seller reserves the right to cancel or refuse any order from a Customer with whom a dispute relating to the payment of a previous order exists.
ARTICLE 6 – PAYMENT
Payment is due at the time of ordering. The Customer may pay using the payment methods accepted and displayed on the website at the time of the order (credit/debit card, etc.).
Payment data is transmitted via a secure system. The Seller does not retain any banking data belonging to the Customer.
ARTICLE 7 – DELIVERY
Products are delivered to the address provided by the Customer at the time of ordering. Delivery timeframes are given on the website as estimates. Any delivery delay shall not entitle the Customer to cancel the order or claim damages, except in the event that the maximum delivery period set out in applicable French consumer law is exceeded.
For deliveries outside France, customs duties or import taxes may be applicable in the destination country. Such costs remain the sole responsibility of the Customer.
In the event of a damaged or missing parcel upon delivery, the Customer is invited to note reservations with the carrier and to contact the Seller as soon as possible at contact@remind-collection.com.
ARTICLE 8 – RIGHT OF WITHDRAWAL
In accordance with Articles L221-18 et seq. of the French Consumer Code, the Customer has a period of fourteen (14) calendar days from receipt of the product to exercise their right of withdrawal, without having to provide reasons or pay any penalties.
To exercise this right, the Customer must notify the Seller of their decision to withdraw by email at contact@remind-collection.com, clearly stating their intention to withdraw (name, order number, product(s) concerned).
The Customer then has fourteen (14) calendar days from the date of notification to return the product(s), in their original condition, complete and unused.
Return shipping costs are borne by the Customer, unless otherwise communicated by the Seller.
Reimbursement will be made within fourteen (14) days of receipt of the returned products or proof of shipment, using the same payment method as the one used at the time of the order.
The right of withdrawal does not apply to personalised products or items made to the Customer's specifications, in accordance with Article L221-28 of the French Consumer Code.
ARTICLE 9 – LEGAL WARRANTIES
All products sold on remind-collection.com benefit from the following legal warranties under French law:
9.1 – Legal warranty of conformity
Pursuant to Articles L217-1 et seq. of the French Consumer Code, the Seller is required to deliver goods conforming to the contract and is liable for any lack of conformity existing at the time of delivery.
In the event of a lack of conformity, the Customer may require the replacement or repair of the goods. If these options are impossible, the Customer may obtain a price reduction or cancellation of the contract with full reimbursement.
The Customer has two (2) years from delivery of the goods to bring a claim under this warranty.
9.2 – Warranty against hidden defects
Pursuant to Articles 1641 to 1649 of the French Civil Code, the Seller is liable for hidden defects in the item sold that render it unfit for its intended use, or that so diminish that use that the buyer would not have purchased it, or would have paid a lower price, had they been aware of the defects.
This warranty applies independently of the legal warranty of conformity.
ARTICLE 10 – PERSONAL DATA
The Seller collects and processes the Customer's personal data for the purposes of fulfilling orders and, where applicable, for commercial prospecting, in accordance with the General Data Protection Regulation (GDPR – EU Regulation 2016/679) and the French Data Protection Act (loi Informatique et Libertés).
The Customer has the right to access, rectify, erase, restrict, object to, and port their personal data. To exercise these rights, the Customer may contact the Seller at contact@remind-collection.com.
For further information, the Customer is invited to consult the Privacy Policy available on the website.
ARTICLE 11 – INTELLECTUAL PROPERTY
All elements of the website remind-collection.com (texts, photographs, visuals, logos, design, structure) are protected by intellectual property law and are the exclusive property of the Seller or are subject to an authorisation of use.
Any reproduction, representation, modification, publication, adaptation or exploitation of all or part of the website's elements, by any means or process whatsoever, is prohibited without the prior written consent of the Seller.
ARTICLE 12 – LIMITATION OF LIABILITY
The Seller shall not be held liable for damages resulting from misuse of purchased products, force majeure, or the actions of a third party.
The Seller endeavours to ensure the availability of the website. However, the Seller cannot guarantee permanent and uninterrupted availability, particularly in the event of maintenance or a technical incident.
The Seller's liability may only be engaged within the limits permitted by applicable French law. These clauses shall not have the effect of excluding or limiting the Seller's liability in cases of gross negligence, fraud, or in respect of statutory warranties imposed by law.
ARTICLE 13 – MEDIATION AND DISPUTE RESOLUTION
In the event of a dispute relating to an order or the application of these Terms, the Customer is invited to contact the Seller's customer service at contact@remind-collection.com in the first instance, with a view to reaching an amicable resolution.
Pursuant to Articles L612-1 et seq. of the French Consumer Code, the Customer may have free recourse to a consumer mediator for the amicable resolution of the dispute. The Customer may also access the Online Dispute Resolution (ODR) platform set up by the European Commission at: https://ec.europa.eu/consumers/odr
In the absence of an amicable resolution, any dispute relating to the formation, interpretation or performance of these Terms shall be submitted to the competent French courts.
ARTICLE 14 – GOVERNING LAW
These General Terms and Conditions of Sale are governed by French law. In the event of a dispute, the parties agree to seek an amicable resolution before initiating legal proceedings.
For Customers residing outside France, please note that mandatory consumer protection provisions of your country of residence may also apply.
ARTICLE 15 – AMENDMENTS TO THE TERMS
The Seller reserves the right to modify these Terms at any time. The applicable Terms are those in force at the date of the order. The current version is available at all times on the dedicated page of the website.
